TERMS OF SERVICE

These Terms of Service ("Terms") govern your use of TheRoom.ink, operated by Cameron Hughes, Upminster, England, United Kingdom ("we", "us", "our"). By creating an account or using TheRoom.ink you agree to these Terms in full. If you do not agree, do not use the platform.

1. THE SERVICE

TheRoom.ink is a booking platform for independent tattoo artists operating in the United Kingdom. It allows artists to create public booking pages, receive booking requests from clients, collect deposits directly from clients, and manage their appointment schedules. TheRoom.ink does not use artificial intelligence in any part of its service.

TheRoom.ink is a technology platform only. We are not a tattoo studio, an employer of tattoo artists, or a party to any transaction or agreement between an artist and a client. We do not provide, supervise, or guarantee any tattoo services.

2. ELIGIBILITY

To use TheRoom.ink you must be at least 18 years of age. By using the platform you confirm that you are 18 or older. We do not knowingly allow persons under 18 to create accounts. If we become aware that an account belongs to a person under 18 we will terminate it immediately.

Clients using the platform to book tattoo services confirm that they meet the legal age requirements for tattooing in their jurisdiction. In England and Wales, it is illegal to tattoo a person under the age of 18. Artists are solely responsible for verifying client age before carrying out any tattoo work.

3. ARTIST ACCOUNTS

To use TheRoom.ink as an artist you must:

We reserve the right to decline, suspend, or revoke artist verification and account access at our sole discretion, including where we believe an account holder is misrepresenting themselves or their services.

4. CLIENT ACCOUNTS

Clients may create an account to submit booking requests, track appointments, and follow artists. Clients are responsible for providing accurate contact information and for attending confirmed appointments. Clients who repeatedly fail to attend confirmed appointments or who engage in abusive or fraudulent behaviour may have their accounts suspended or terminated.

5. SUBSCRIPTIONS AND BILLING

Artist accounts are subject to a 30-day free trial with no payment required. After the trial period, a monthly subscription fee is required to maintain an active booking page. The current standard rate is £25 per month.

Promotional discount codes applied at signup provide a percentage reduction to the applicable subscription rate for 24 months from the date of first subscription, provided your subscription remains active and in good standing. After 24 months, the standard rate applies. Discounts are non-transferable and cannot be applied retrospectively.

Subscription fees are billed monthly via Stripe. Failure to maintain an active subscription will result in your booking page being deactivated until payment is brought up to date. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

All subscription fees are exclusive of VAT where applicable. Artists are solely responsible for their own tax obligations including any VAT registration requirements arising from their subscription or from income received through the platform.

6. DEPOSITS AND PAYMENTS

TheRoom.ink facilitates the collection of deposits from clients on behalf of artists using Stripe, a third-party payment processor. By using the platform you agree to be bound by Stripe's Terms of Service.

Deposit amounts are set entirely by the artist. A card processing fee is added to the client's payment to cover Stripe's transaction costs. This fee is displayed clearly to the client before payment is made. TheRoom.ink does not charge a commission on any deposit or transaction.

Upon connecting their Stripe account, artists receive deposits directly into their own Stripe account. TheRoom.ink does not hold, process, or have access to artist or client funds at any point. We are not a payment institution and do not provide payment services.

7. REFUNDS

TheRoom.ink is not responsible for refunds, and does not mediate, guarantee, or process refunds between artists and clients. All refund decisions are at the sole discretion of the artist. We do not determine whether a refund is owed and we will not intervene in refund disputes.

The platform provides tools that allow artists to issue refunds to clients via Stripe directly from their dashboard. Use of these tools is voluntary and entirely at the artist's discretion. Clients may submit a refund request through the platform, which notifies the artist — this does not obligate the artist to issue a refund.

Stripe allows refunds to be issued up to 180 days after the original payment. After this period, refunds cannot be processed through the platform and any resolution must be arranged directly between the artist and client. Card processing fees paid to Stripe are non-refundable in all circumstances.

If you are a client who believes you are owed a refund and the artist has not responded, your recourse is to contact your card issuer to initiate a chargeback. TheRoom.ink will not be involved in chargeback disputes, which are handled directly between the client, the artist's Stripe account, and the relevant card network.

As an artist on TheRoom.ink, you are solely responsible for:

To receive client deposits, artists must connect a Stripe Express account through the platform. By doing so, artists agree to Stripe's Connected Account Agreement. TheRoom.ink is not responsible for any interruption, failure, or restriction of Stripe's services, including account holds, freezes, or disputes handled by Stripe directly.

You may not use TheRoom.ink to:

11. INTELLECTUAL PROPERTY

You retain full ownership of any content you upload to TheRoom.ink, including portfolio images, flash designs, and profile information. By uploading content you grant TheRoom.ink a non-exclusive, royalty-free licence to display that content on the platform for the purpose of operating the service. We will not use your content for marketing or promotional purposes without your explicit consent.

The TheRoom.ink name, logo, and platform design are the intellectual property of Cameron Hughes and may not be reproduced, copied, or used without prior written permission.

12. DATA AND PRIVACY

We collect and process personal data in accordance with our Privacy Policy. By using TheRoom.ink you agree to the collection and use of your data as described in that policy. We are committed to compliance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Artists are considered data controllers in respect of client data they collect through the platform. Artists are independently responsible for complying with applicable data protection law in relation to client data they hold or process.

13. LIMITATION OF LIABILITY

TheRoom.ink is a booking platform only. To the maximum extent permitted by applicable law:

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.

14. TERMINATION

We may suspend or terminate your account at any time if you breach these Terms, engage in conduct we reasonably consider harmful to the platform or its users, or if required to do so by law. Where possible we will give you notice, but we reserve the right to act immediately in serious cases.

You may close your account at any time by contacting us at support@theroom.ink. Closing your account does not entitle you to a refund of any subscription fees already paid. Data associated with your account will be handled in accordance with our Privacy Policy.

15. CHANGES TO THESE TERMS

We may update these Terms from time to time. Where changes are significant, we will notify artists by email at least 14 days before the changes take effect. Continued use of the platform after changes take effect constitutes acceptance of the revised Terms.

16. GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
